The terms and conditions governing your use of PT Alarms Fire & Security's website, services, and engagement with our 14-service security ecosystem.

Agreement to Terms.

By accessing or using the PT Alarms Fire & Security website ("Website") or engaging our security and emergency services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use our Website or Services.

These Terms constitute a legally binding agreement between you and PT Alarms Fire & Security (Pty) Ltd, a company registered in South Africa with registration number 1999/012345/07, with its principal place of business at 13 Phila Ndwandwe Road, Isipingo, Durban, KwaZulu-Natal, 4115.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page, with the "Last Updated" date revised accordingly. Your continued use of the Website or Services after any changes constitutes acceptance of the revised Terms.

Important: These Terms apply in addition to any separate service agreement, quotation, or contract you may enter into with PT Alarms for specific security services. In the event of any conflict, the terms of your specific service agreement shall prevail over these general Terms.

Definitions.

For the purposes of these Terms, the following definitions apply:

  • "Client" means any individual, business, or organisation that engages PT Alarms for security or emergency services.
  • "Content" means all text, images, graphics, logos, videos, audio, software, and other materials available on the Website.
  • "Emergency Services" means armed response, emergency medical services, fire safety response, air support, and other time-critical services provided by PT Alarms.
  • "Force Majeure" means events beyond our reasonable control, including but not limited to natural disasters, civil unrest, acts of war, terrorism, pandemics, government actions, and internet or telecommunications failures.
  • "Intellectual Property" means all patents, trademarks, copyrights, trade secrets, and other proprietary rights.
  • "PSIRA" means the Private Security Industry Regulatory Authority of South Africa.
  • "Service Agreement" means any written contract, quotation, or proposal accepted by the Client for the provision of specific security services.
  • "User" means any person who accesses or uses the Website, whether or not they are a Client.

PT Alarms provides a comprehensive range of security and emergency services, including but not limited to:

  1. Guarding Services (static and mobile)
  2. Armed Response
  3. CCTV Installation and Monitoring
  4. Access Control Systems
  5. Electric Fencing
  6. Emergency Medical Services (EMS)
  7. Tactical Response and K9 Units
  8. 24/7 Control Room Monitoring
  9. Retail Security and Loss Prevention
  10. Air Support (helicopter)
  11. Fire Safety and Detection Systems
  12. Technical Installations and Support
  13. Security Risk Assessments
  14. Investigation Services

Service Scope and Limitations

The specific scope, deliverables, service levels, and limitations of any service engagement are defined in the applicable Service Agreement or quotation. Unless otherwise specified in writing:

  • Response times are targets, not guarantees, and may be affected by traffic, weather, Force Majeure events, and other factors beyond our control.
  • Our liability for any single incident is limited to the fees paid by the Client for the specific service in the 12 months preceding the incident, or R100,000 (whichever is lower), unless a higher limit is agreed in writing.
  • We do not guarantee the prevention of all criminal activity, property damage, injury, or loss. Our services are designed to deter, detect, and respond to security threats, not to eliminate all risk.
  • Emergency medical services are provided by qualified paramedics within the scope of their training and certification. We are not a hospital or medical facility and cannot provide definitive medical treatment.

Service Level Agreements (SLAs)

Where SLAs are specified in a Service Agreement, they apply only to the services and geographic areas explicitly covered by that agreement. SLA credits or remedies, if any, are the Client's sole and exclusive remedy for SLA failures and are subject to the limitations set out in these Terms.

Eligibility.

By using our Website or Services, you represent and warrant that:

  • You are at least 18 years of age or have the legal capacity to enter into binding contracts in South Africa.
  • If you are using the Website or Services on behalf of a company or organisation, you have the authority to bind that entity to these Terms.
  • You will provide accurate, current, and complete information when requested.
  • You will comply with all applicable laws, regulations, and industry standards, including PSIRA regulations where relevant.

User Accounts.

Certain features of our Website or Services may require you to create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain the security of your account credentials and not share them with third parties.
  • Notify us immediately of any unauthorised access to or use of your account.
  • Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate your account at any time, without notice, if we believe you have violated these Terms or engaged in fraudulent, illegal, or harmful activity.

Acceptable Use.

You agree not to use the Website or Services for any unlawful purpose or in any way that could damage, disable, overburden, or impair our systems. Specifically, you agree not to:

  • Use the Website or Services to transmit any unlawful, threatening, defamatory, obscene, or otherwise objectionable content.
  • Attempt to gain unauthorised access to any portion of the Website, server, or network.
  • Use automated systems (robots, spiders, scrapers) to access the Website without our express written permission.
  • Interfere with or disrupt the integrity or performance of the Website or Services.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.
  • Use the emergency contact numbers or services for non-emergency purposes, prank calls, or any purpose other than genuine security or medical emergencies.
  • Reverse engineer, decompile, or disassemble any software or technology used in connection with the Services.

Violation of these acceptable use provisions may result in immediate termination of your access to the Website and Services, and may subject you to civil and criminal liability.

Intellectual Property.

All Content on the Website, including but not limited to text, graphics, logos, images, videos, audio clips, software, and the overall design and layout, is the property of PT Alarms or its licensors and is protected by South African and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Website for personal, non-commercial purposes. You may not:

  • Reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any Content without our prior written consent.
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices from the Content.
  • Use any PT Alarms trademarks, logos, or trade names without our express written permission.

Any feedback, suggestions, or ideas you provide to us regarding the Website or Services may be used by us without restriction or compensation to you.

Disclaimers.

THE WEBSITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, PT ALARMS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Warranties that the Website will be uninterrupted, timely, secure, or error-free.
  • Warranties that the results obtained from using the Website or Services will be accurate or reliable.
  • Warranties regarding the quality of any products, services, information, or other material obtained through the Website.

PT Alarms does not warrant that the Website or Services will meet your requirements, or that any errors in the Website will be corrected. No advice or information, whether oral or written, obtained from PT Alarms or through the Website shall create any warranty not expressly stated in these Terms.

Limitation of Liability.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PT ALARMS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • Loss of profits, revenue, data, use, goodwill, or other intangible losses.
  • Damages resulting from unauthorised access to or alteration of your transmissions or data.
  • Damages resulting from any conduct or content of any third party on the Website or Services.
  • Damages resulting from criminal activity, theft, vandalism, or other unlawful acts that occur despite our security measures.

Our total liability to you for all claims arising out of or relating to these Terms or your use of the Website or Services shall not exceed the greater of:

  • The amount you have paid to PT Alarms in the 12 months preceding the claim; or
  • R100,000 (one hundred thousand Rand).

This limitation of liability applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if PT Alarms has been advised of the possibility of such damage.

Security Services Disclaimer: PT Alarms provides security services designed to deter, detect, and respond to criminal activity and emergencies. However, no security system or service can guarantee the prevention of all crime, injury, property damage, or loss. Our services reduce risk but do not eliminate it. Clients acknowledge and accept that PT Alarms cannot be held liable for losses arising from criminal acts that occur despite reasonable security measures being in place.

Indemnification.

You agree to indemnify, defend, and hold harmless PT Alarms and its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:

  • Your use of the Website or Services.
  • Your violation of these Terms.
  • Your violation of any rights of a third party, including intellectual property rights.
  • Any content you submit, post, or transmit through the Website.
  • Your negligent or wilful misconduct.

Termination.

These Terms remain in effect until terminated by either party. PT Alarms may terminate or suspend your access to the Website or Services immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms.
  • Fraudulent, illegal, or harmful activity.
  • Non-payment of fees for Services rendered.
  • Repeated misuse of emergency services or contact numbers.

Upon termination, all provisions of these Terms which by their nature should survive termination shall survive, including but not limited to: intellectual property provisions, disclaimers, indemnification, limitation of liability, and governing law.

For Clients with active Service Agreements, termination of these Terms does not automatically terminate the Service Agreement. The Service Agreement continues in accordance with its own terms until properly terminated in writing by either party in accordance with the notice periods specified therein.

Governing Law & Jurisdiction.

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by arbitration in Durban, KwaZulu-Natal, in accordance with the Arbitration Foundation of Southern Africa (AFSA) Rules. The arbitration shall be conducted by a single arbitrator appointed in accordance with those Rules. The language of the arbitration shall be English.

Notwithstanding the above, either party may seek urgent interdictory or declaratory relief from a court of competent jurisdiction in Durban, KwaZulu-Natal.

Changes to These Terms.

We reserve the right to modify or replace these Terms at any time at our sole discretion. Material changes will be notified to Users via:

  • A prominent notice on the Website homepage.
  • Email notification to registered account holders.
  • Update to the "Last Updated" date at the top of this page.

It is your responsibility to review these Terms periodically. Your continued use of the Website or Services after any changes constitutes binding acceptance of the revised Terms.
